- Failed To Disclose Record To Senate Committee: In a letter sent to the Department of Justice on October 11, Senate Judiciary Democrats raised concerns about SCOTUS nominee Amy Coney Barrett’s lack of transparency, including controversial omissions on her Senate questionnaire. In their letter, the SJC Democrats implored to the Justice Department to “immediately provide an explanation for the omission” and to “provide any other responsible materials that have not been disclosed by Judge Barrett.”
- Anti-Choice Barrett Would Overturn Roe Vs Wade; Dangerous For Reproductive Rights: Barrett's has stated her desire to oveturn Roe vs Wade, and is hostile to abortion rights generally. Furthermore, she believes that life begins at conception, and has signed onto a letter that called emergency contraception an "embryo-destroying" pill.
- Opponent Of LGBTQ Rights, Including Marriage: Amy Coney Barrett allied herself with an anti-LGBT hate group and has consistently opposed the rights of sexual minorities, both personally and from the bench.
- Barrett Opposed Our Current System Of Informing Arrestees Of Their Rights: The requirement to give Miranda Warnings established a universal standard, requiring people in police custody be read their rights before being questioned. Barrett claimed that Miranda rights went beyond what the Constitution intended, stating that she believed there was a gap between constitutional norms and the tests by which those norms were implemented.
- Sentencing Disparities For Cocaine: In 2007 the U.S. Sentencing Commission decided to bring sentencing minimums for crack in line with powder cocaine that applied retroactively. The sentencing minimums had been established in 1986 had a 100-to-one disparity between the two substances and led to massive race disparities, as 79% of sentenced crack offenders were black compared to 10% white. In 2008, Barrett criticized the reversal attacking the retroactive application on grounds that it would be too logistically challenging.
- Barrett Denied An Appeal To A Man Transferred To A New Workplace Because Of His Race: Barrett voted with the 5-3 majority to deny the appeal of a man who was transferred from one Auto Zone store to another due to his race.
- ⚖️ Extreme Judicial Philosophy: Barrett was a self-declared texualist and originalist in the mold of her former boss Justice Scalia. Barrett argued the Supreme Court may not have supervisory power over lower courts opening up the possibility for new interpretations of stare decisis at the appellate level.
- Barrett Opposed Supreme Court Nominations In Situations Like Her Own: In 2016, Barrett highlighted that the Merrick Garland nomination represented a “staunch conservative” Scalia being replaced by a left leaning Justice, which would not be ‘a lateral move.’ She also commented that ‘it shouldn’t be a surprise that the Senate is willing to push a President’s nominee through an election year’ and that she did not think precedent established a rule for either side in the debate.
